Terms of Service
These Terms of Service (“Terms”) govern an agent's use of Frontage. By signing in, the agent agrees to these Terms.
1. What Frontage is — and isn't
Frontage is a software platform for real-estate agents to draft, review, and publish marketing content. Frontage is not a real-estate brokerage. Frontage does not list, sell, lease, or advise on the purchase of real property. Compliance with brokerage policy, MLS rules, the Fair Housing Act, the NAR Code of Ethics, state advertising rules, and any applicable platform terms remains the agent's responsibility.
2. Agent eligibility
- The agent must hold an active real-estate license in the state(s) where they market.
- The agent must have authority from their brokerage to use AI-drafted content for marketing.
- The agent must be at least 18 years old.
3. The agent's content
The agent retains ownership of any photos, voice memos, captions, brand-voice profile, and other content they upload or generate via Frontage. The agent grants Frontage a non-exclusive license to host, process, transmit, and display that content as needed to operate the service. Frontage does not claim ownership of the agent's content.
4. AI-generated drafts
Frontage uses third-party large-language-model providers (currently Anthropic) to draft captions and to scan drafts for compliance issues. AI drafts are suggestions. The agent is the publisher of record. The agent must review every draft before approving it for publication and is solely responsible for what they publish.
5. Compliance scanning
Frontage runs automated compliance checks (Fair Housing, NAR Article 12, license-disclosure, platform-AI-labeling). These checks are best-effort. They do not constitute legal advice and do not guarantee compliance. Tyler Crawford, founder of Frontage, has documented in TYLER_TODOS that the FHA scanner ruleset must be reviewed by a fair-housing attorney before production launch.
6. SMS to leads
When the agent uses Frontage's SMS feature (powered by Twilio), they affirm that they have captured prior express written consent from the recipient as required by the TCPA, and that they will honor STOP / opt-out requests promptly. Frontage will refuse to send SMS to a lead who has opted out, regardless of the agent's instruction.
7. Subscription and billing
Plans are billed monthly or annually via Stripe. Subscription fees are non-refundable except where required by law. Cancellation takes effect at the end of the then-current billing period; the agent retains access through that date.
8. Acceptable use
- No use of Frontage to publish content the agent knows or should know to be discriminatory under federal or state fair-housing law.
- No use of Frontage's SMS feature to send to recipients who have not opted in.
- No reverse-engineering, scraping at scale, or bypassing rate limits.
- No use of the AI drafter to impersonate other licensed agents or brokerages.
9. Termination
Either party may terminate the agreement at any time. Frontage may suspend or terminate access for material breach (most importantly: pattern of FHA-flagged content overrides without documented cause) or non-payment.
10. Disclaimers
FRONTAGE IS PROVIDED “AS IS.” WE DISCLAIM ALL IMPLIED WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW. AI DRAFTS AND COMPLIANCE SCANS ARE NOT LEGAL ADVICE. THE AGENT REMAINS THE LICENSED PROFESSIONAL OF RECORD FOR EVERYTHING THEY PUBLISH.
11. Limitation of liability
To the maximum extent permitted by law, Frontage's total liability for any claim arising out of these Terms is limited to the fees paid by the agent in the twelve months preceding the claim.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Sacramento County, California.
13. Changes
Material changes will be emailed to agents at least 14 days before they take effect.
